Practical information - Certificate from the European Judicial Records Register

The local criminal record Office issues:

  • The Certificato del casellario giudiziale europeo [European criminal record certificate from the European Criminal Record Information System ECRIS] (art. 22 t.u), if requested by the defence counsel, allowed by the judge, in order to know the criminal convictions concerning the witness or the injured party when they are Italian citizens.
  • The informazione con valore legale sui precedenti penali [Legal information about final criminal convictions], if requested by the defence counsel, allowed by the judge, in order to know the criminal convictions concerning the witness or the injured party when they are not Italian citizens.
  • The Certificato del casellario giudiziale europeo, if referred to an Italian citizen (art. 25-ter, par. 1, t.u.) and the Informazione con valore legale sui precedenti penali, if referred to citizens of other Member States (art. 25-ter, par. 2, t.u.), required by private citizens.
  • The Certificato del casellario giudiziale europeo, in case it refers to an Italian citizen (art. 28-bis, par. 1, t.u.) and the Informazione con valore legale sui precedenti penali, if referred to citizens of other Member States (art. 28-bis, par. 2, t.u.), upon request of a public authority/company managing a public utility, if needed for the performance of their activities.

The Certificato del casellario giudiziale europeo [European criminal record certificate from the European Criminal Record Information System ECRIS] states all final criminal convictions issued by all European Union’s Member States concerning a given Italian citizen.

The Informazione con valore legale sui precedenti penali [Legal information about final criminal convictions] states all the criminal convictions issued by all Member States concerning a person who is not an Italian citizen.

Member states connected to ECRIS:

All EU member countries, including the United Kingdom, except Malta, Portugal, Slovenia and Greece, with which the connection is in progress.

The certificate and the Information are valid for 6 months from the date of issue.

Cost of the certificate and of the information:

Each certificate or information requires payment, by means of  duty stamps, of the following sums:

  • € 3,92 for diritti di certificato [certificate fee]; and
  • € 16.00 for  marca da bollo  [stamp duty]  (n.b.: one stamp duty every two pages of the certificate)

Certificates to be issued on the same day of  the request require the additional payment of:

•    € 3.92 for diritto d’urgenza  [urgency fee]

Nota bene n. 1: Please note that for the Informazione con valore legale sui precedenti penali, the emergency service is not provided, as it is not possible to secure its release before the 10 days (period for the issue imposed by the standard at national citizenship criminal record register of the European subject or at the national criminal record register of residence and / or stay for third-country citizens). For the Informazione con valore legale sui precedenti penali it is not applied, therefore, the urgency fee.

Nota bene n. 2: Please be advised the acknowledgement of every convictions, and any forbiddances because of them, all over the EU is only possible by acquiring the “certificato del casellario giudiziale” [certificate from the Judicial Records Register] together with the “certificato del casellario europeo” [certificate from the European Judicial Records Register] or, if the case, with the “informazione con valore legale” [legal information about final criminal convictions] (not yet available to be reserved on line), in compliance with the relevant European law (Framework Decision GAI/315/2009 and Decision GAI/316/2009, carried out by the Italian Decrees nn. 74/2016 and 75/2016).
